1. General Terms

This website is operated by LIGHT 'EM UP LTD ("LEU", "we", "us", "our"). By using this website and our services, you (“you”, “your”), the buyer, confirm that you:

  • Are at least 21 years old or of legal smoking age in your jurisdiction.

  • Have passed our mandatory age verification process before accessing content or making purchases.

  • Accept and are bound by our Terms & Conditions, Privacy Policy, and Shipping & Return Policy.

If you do not agree with these terms, you must not use our services.

We accept no liability arising from the use of this website or the products sold. By accessing our site or purchasing from us, you agree to all applicable terms.

2. Youth Protection

LEU does not sell or ship tobacco products to anyone under 21 years of age.

Access and purchase require successful verification via VerifyMyAge, which uses AI and human checks to validate government-issued IDs (e.g., passports, driver's licenses, residence cards).

3. Responsibilities of the buyer, Incoterms, Duties, Taxes & Restrictions

  1. Delivery term. Unless we agree otherwise in writing, all cross-border shipments are made DAP – Delivered at Place (Incoterms® 2020) to the address you provide (also referred to as DDU in some markets) - except Switzerland where we ship DDP – Delivered Duty Paid.

  2. Legality & buyer responsibility. It is your sole responsibility to ensure that purchasing and importing tobacco products is lawful in your jurisdiction. Tobacco regulations vary widely and may include import bans, quantity limits, excise duties, plain-packaging, and health-warning requirements. Before placing an order, you must verify with your local customs or regulatory authorities whether cigar imports are permitted and what obligations apply to you. By ordering from LEU, you confirm that you understand your local obligations and are in compliance with applicable laws and age restrictions.

  3. Importer of Record (IOR). You are the Importer of Record. You are responsible for completing all clearance procedures required by your customs office and for any destination-country requirements (e.g., permits, age verification, plain packaging/health warnings, tax stamps, quantity caps).

  4. Taxes, duties, and fees. All duties, VAT/GST, excise taxes, customs fees, brokerage/clearance and disbursement fees imposed by your country are your sole responsibility and must be paid by you. You authorize the carrier, customs broker, or postal operator to act as your agent to make customs declarations on your behalf and to advance and collect any such amounts from you.

  5. Customs declarations. LEU declares shipments truthfully in accordance with customs law, including accurate product descriptions, values, and country of origin.

  6. No local registrations / role limitations. LEU does not act as the importer, customs declarant, or customs broker in your country and does not hold local tobacco retail, distance-selling, or health-authority registrations. Our responsibility ends upon tender of the goods for carriage under the stated Incoterm and delivery to the named place.

  7. Seizure, delays, refusal to pay, and returns. LEU accepts no responsibility for import restrictions, customs delays, or seizure of goods. If you refuse to pay duties/fees and the parcel is returned to us in resellable condition, we may refund the product value only, minus shipping and a 20% restocking fee. If the shipment is seized, destroyed, or not returned, no refund will be issued.

  8. Age verification. By ordering, you confirm you are of legal age to purchase tobacco in your jurisdiction and will provide government-issued ID to the carrier or authorities if requested.

  9. Packaging & labeling differences. Product images may reflect origin-market packaging. Destination-specific labels or plain packaging are your responsibility unless we explicitly agree otherwise in writing.

Note: We do not ship Cuban cigars to the United States.

4. Payments

Payments are processed in Euros (USD) via a PCI-compliant third-party provider (e.g., VISA, Mastercard).

  • Your card may be pre-authorized and charged shortly after order confirmation.

  • Please contact us before initiating any chargebacks or disputes.

  • Orders flagged as potentially fraudulent will be held for verification. Fraud will be prosecuted.

5. Content Accuracy

While we strive for accuracy, we do not guarantee that product descriptions, pricing, or images are error-free. Props shown in photos (e.g. drinks, accessories, food props) are not included. Cigars are shipped in their original packaging. We do not sell single cigars.

We reserve the right to correct errors and are not bound to honor pricing published in error.

6. User Accounts & Submitted Content

When creating an account, you are responsible for maintaining its security and for all activities under your login.

By submitting content (reviews, uploads, etc.), you confirm:

  • You have the rights to the content and it does not violate any law, regulation, or third-party rights.

  • The content is not misleading, obscene, violent, defamatory, or unlawful.

  • It does not contain malware, spam, or deceptive commercial content.

By uploading content, you grant us a worldwide, royalty-free license to use, display, and adapt it for promotional and operational purposes. We reserve the right to remove or refuse content at our discretion.

LEU acts as a platform and is not liable for user-generated content. Linked third-party sites are used at your own risk.

7. Copyright & Intellectual Property

All trademarks, logos, and materials on this website (including lightemupgo.com and lightemupworld.com) are owned by LEU unless otherwise stated. Use does not grant you rights to copy, modify, or reproduce any materials.

8. Account & Third-Party Logins

By registering a LEU account, you gain access to our services. We may update or modify these services at any time. You agree to receive relevant account-related communications via email.

If linking your LEU account to services like Google or Facebook, you agree to their respective terms. You may disconnect these at any time.

9. Termination

We may suspend or terminate your access at any time without notice or liability. You may discontinue use or delete your account at any time.

10. Disclaimers & Limitation of Liability

Our website and services are provided “as is”, without warranties of any kind.

  • We disclaim all responsibility for availability, accuracy, or fitness for a particular purpose.

  • You agree that any claims or disputes arising from third-party actions must be pursued against those parties directly, not LEU.

  • You agree to indemnify LEU, its employees, and partners from any claims arising from your use of our services.

We make no medical claims. All products are for personal use only.

11. Code of Conduct

LEU is committed to a harassment-free experience for all users, regardless of gender, race, religion, disability, or identity.
Please report inappropriate behavior to our support team.

12. Transferability, Severability & Jurisdiction

You may not transfer your rights under these terms without our written consent. We may assign our rights at any time.

If any provision of these terms is deemed invalid or unenforceable, the rest remain in effect.

These terms are governed by the laws of Cyprus, unless overridden by mandatory consumer protection laws.
All disputes fall under the jurisdiction of the courts in Limassol, Cyprus.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the current version.
